1. About BikePart
BikePart (“we”, “us”, “our”) is a South African online marketplace for second-hand motorcycle parts, operated as a private service. By accessing or using our platform at times-of-old.vercel.app, you agree to these Terms of Service in full.
2. Eligibility
You must be at least 18 years old and a resident of South Africa to register as a seller. Buyers may browse without an account. By using BikePart, you represent that you meet these requirements.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Listings & Seller Responsibilities
- Sellers must accurately describe the condition, compatibility, and provenance of all parts listed.
- Listings may not include stolen goods, illegal modifications, or counterfeit parts.
- Listings expire after 14 days. Sellers are responsible for renewing or removing expired stock.
- Trial accounts are limited to 1 free listing. Continued selling requires a paid subscription.
- We reserve the right to remove any listing that violates these terms without notice.
5. Subscriptions & Payments
Seller subscriptions are billed monthly via PayFast. By subscribing you authorise recurring charges at the selected plan rate (Basic: R20/month, Premium: R79/month). Subscriptions renew automatically and can be cancelled at any time. No refunds are issued for partial billing periods.
6. Transactions Between Users
BikePart is a listing platform only. We do not process payments between buyers and sellers, hold funds, or guarantee the condition of any part listed. All transactions are conducted directly between users. We strongly encourage buyers to inspect parts in person before payment.
7. Disputes
We offer a voluntary dispute mediation service. If you have a dispute with another user, you may raise it via our platform. Our mediators will make reasonable efforts to facilitate a resolution but our decisions are non-binding and we accept no liability for the outcome of any transaction.
8. Prohibited Conduct
- Posting false, misleading, or fraudulent listings.
- Harassing, threatening, or abusing other users.
- Attempting to circumvent our subscription system.
- Scraping, crawling, or automated access to our platform without permission.
- Impersonating another user or BikePart staff.
9. Intellectual Property
All platform content, design, and code is the property of BikePart. User-submitted listing content remains the property of the submitting user, but by posting you grant us a non-exclusive licence to display it on the platform.
10. Limitation of Liability
BikePart provides this platform “as is” without warranties of any kind. We are not liable for any loss or damage arising from your use of the platform, transactions between users, or the accuracy of any listing. To the maximum extent permitted by South African law, our total liability to you shall not exceed the subscription fees paid in the three months preceding any claim.
11. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.
12. Changes to These Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.
